Judicial Activisim Alert!

Goddamnit.  So Justice Robert B. Wiggins of the State Supreme Court of Livingston County New York decided that the ironically named New Yorkers for Constitutional Freedoms (for straight people only) can proceed with their case seeking to overturn the equal marriage law passed this June and nullify marriages granted under it.

The case seems to hinge entirely upon the argument that Governor Cuomo and possibly Mayor Bloomberg violated the state's Open Meetings Law while discussing the bill with the Republican caucus at the Executive Mansion and the Capitol.  Who would have thought that a threat to the legality of same-sex couples getting married in New York state would come from implications that Republicans legislators participated in bending the rules to get the bill passed?  Towelroad is saying that the Judge was pessimistic about the lawsuit's prospects, but I don't know where they're getting that insight.  However, they did provide this perspective on the claim regarding Open Meetings Laws:

some meetings were indeed private. But, the open meetings law does not explicitly require that every meeting of more than one person be open to every Joe, Tim, and Sally who's interested. Nor is it meant to uproot the entire legislative process. To invalidate one law on the grounds that some people conducted some closed door meetings would set a dangerous precedent that could invalidate nearly every law Albany passes, including every budget since the 1950s, the law that sent computer money to certain public schools, and the law that named a state building after the Rev. Diaz.

Another point of the case is that Cuomo violated the constitution by failing to hold the bill for three days before the legislature voted on it.  However, this requirement can be dismissed if the legislation requires immediate emergency action.  The Governor used admittedly flimsy logic to certify that the bill required an immediate vote, and it appears that the Judge has ruled that the Governor followed procedure and the charge has no merit.

Reverend Jason J. McGuire (pictured, nice face), executive director of  New Yorkers for Constitutional Freedoms, stated in response to the ruling:

“We have said all along that we look forward to our day in court.  Now we will have it. The legality of our legislative process must be protected.”

I just have one question, why is it judicial activism when gays get rights through the courts, but justice when conservatives seek to take rights away from gays through the courts.

this morning i saw a headline about protests against an authoritarian ruler in tunisia. last night he said he's stop using live ammo on protesters, which just made folks get on twitter and facebook to organize bigger protests. well, it seems they were successful. the corrupt leader was overthrown and fled the country, and get this -

"Some demonstrators also cited the evidence of cables from the United States Embassy in Tunisia that were released by the anti-secrecy group WikiLeaks providing vividly detailed accounts of the first family’s self-enrichment and opulent lifestyle."

this also marks the first time an arab leader has been overthrown through protests.

i had a feeling this wikileaks thing would turn out for the best somehow. way to go wikileaks. and america, we shouldn't be so shy when gossiping about other countries.

these levi's "go forth" adverts have been floating around for a couple months. they each feature walt whitman poems (one, an actual recording of him reading the first four lines of his poem america). they get you all emotional about denim and bein' an amurican, and i think they would make don draper proud. i'm just glad someone finally found a use for these silly stupid poems.

17 year-old unseeded melanie oudin (she's from georgia, of all places!) just defeated the number 4 seed, elena dementieva. that's outrageous!

in men's singles, university of kentucky grad jesse witten won his second round match against some spanish dude, after beating the 29 seed earlier this week. looks like this us open is shaping up well for the americans all around!

and finally, 10-seed fernando verdasco is showing his UT pride. lookin' good!

A healthy democracy requires vigorous debate, and in spirited opposition to the KOCH Industries Inc. funded grassroots organization, Americans For Prosperity, I would like to found the Americans for Failure, Euthanasia and Forced Abortions, or AFEFA.

Some people might think AFEFA is un-American. But hell, what isn't un-American these days? War protesting hippies are un-American, gun toting rednecks with swastika signs at town hall meetings are un-American, it's all a wash. I contend that AFEFA is perhaps the most ultra-American organization to ever grace God's green earth, because we espouse the belief that America is better than prosperity.

Ask yourself, what's the big deal with prosperity anyway? The more you have, the more you stand to lose. That's why we demand failure. Failure is easy, it can be quick, and once you hit bottom, you always know where you stand. Fact: every prosperous civilization in the history of the world has eventually failed and been replaced by a successor. It's time we break the cycle of prosperity and failure, with enduring failure. Why delay the inevitable? Let's let China take up the futile pursuit of success, because we're better than that.

Still not convinced? Consider Jesus. By modern standards, the man would be considered a complete and total failure. What do you think his FICO score would be? He might have been able to turn water into wine, but I doubt he could turn a 300 into plastic. The point is, the son of God is intended to be our supreme example, the one to show us the way to eternal life, and yet there's no way in hell he could swing a mortgage. According to his bank ledger, one would be lead to believe that bankruptcy is next to Godliness. Given this is a Christian nation shouldn't we be giving failure the chance it deserves? I think so.
